A federal judge in New Zealand has ordered the Food and Drug Administration to stop selling Viagra to the public in the first month of its approval of the drug.
The FDA is to be required to issue a warning on the label, but the agency's decision has been subject to several court battles.
Under the FDA's regulations, a prescription drug can't be sold without a doctor's supervision. Instead, the drug must be approved by the Food and Drug Administration.
The FDA is now requiring more than a dozen medical professionals to sign off on an abbreviated new drug application for the drug, including anyone who is allergic to sildenafil, tadalafil or similar drugs. Some of the doctors are also required to have the drug's label read before they prescribe it.
The agency has also ruled that the drug has a weak side effect profile, and that it can't be sold without the approval of a physician.
The decision is likely to take effect after the FDA approves Viagra, the drug which treats men with erectile dysfunction, according to a statement.
A federal judge in New Zealand said in a filing that "the FDA will not continue to issue its warning to physicians who prescribe Viagra and have the drug available to patients without requiring them to sign an abbreviated new drug application or to submit it to the FDA."
The decision is the latest in a series of lawsuits in New Zealand that have raised serious legal questions about how widely approved the drugs are.
"The FDA has acted responsibly and legally, and the regulatory framework will not be compromised by the failure of the agency to act on the information sought," the New Zealand law firm said in a statement.
The FDA's role in the pharmaceutical industry is to help doctors find safe alternatives to drugs.
But in the past few months, the company's legal battle with the FDA over the agency's decision has come to a head.
"A decision that a physician is required to sign before prescription drugs can be sold will not change the fact that a physician's choice is based on the patient's medical history and does not reflect the medical realities of a given situation," the statement said.
The FDA said it has also ruled against the company's move, but it also noted that the company did not "directly or indirectly" promote Viagra, but rather, marketed it as a "nonprescription" drug.The decision will come at a time when the FDA faces a growing concern about the safety of prescription drugs that treat conditions such as diabetes, heart disease and high blood pressure.
Viagra has been on the market for several years, but its approval in a New Zealand study in 2002 by the American Heart Association showed that up to 90 percent of men who took Viagra had erectile dysfunction.
That study found that 83 percent of men with erectile dysfunction were taking sildenafil. That study showed that "as many as 20 percent of men taking Viagra were also taking sildenafil."
A second study in the same year found that the drug is effective in "treating a wide variety of erectile dysfunction conditions," including men with diabetes, high blood pressure and pulmonary arterial hypertension, according to the FDA.
The FDA is also taking steps to ensure that Viagra remains a safe option for men who have heart disease.
